Most people who have not had a close loved one age and pass away will be oblivious to the many end- of -life issues that arise.
Most people do not want to think about the inevitable.
Unfortunately, disability and death know no age restrictions. These life- changing experiences can affect us at any age.
Unfortunately, as our baby boomers reach this stage of life these issues become imperative.
There is something you can do to protect yourself and your family and I can help you do it.
Anyone over the age if 18 years should consider these 4 important legal documents. They have been designed to make your and your family’s lives easier and less expensive.
Will. This formal document records your directions regarding your assets after you die. If you do not have one, the Administration Act will apply. You may not like or want the consequences!
Advance Health Directive. Also known as a “living will” or a “non-resuscitation” document, the AHD gives express directions by you to your family and health professionals about what treatment you are not to be given if you are “at the end of the line” but still alive. Doctors have an obligation to keep you alive, notwithstanding the painful suffering and terminal nature of your condition. This is oftentimes most undesirable. You can express your instructions on this issue only in this unique document.
Enduring Power of Attorney.  By this wonderful document you appoint others to do things for you that the law will not recognise unless they have it. It opens doors for those assisting you in all your financial affairs and dealings with third parties – eg, banks, tax office, titles office, share registries etc and generally all money matters.
Enduring Power of Guardianship.  Just like the above, but this time the person who is appointed manages your day- to- day life issues when you are unable to do so. So, where you live, who you mix with, what you do daily etc. All your personal, lifestyle and medical decisions, but not those covered by the AHD.

Note: you cannot make a will after you have died! Unless you know for sure when you are going to die, get one done!

Note: you cannot make any of these documents if you no longer have full mental capacity (ie, if you have either wholly or partially lost your marbles) or are unconscious, so get them done sooner rather than later.
